and Zittau (Germany)
It is the only town in Poland which was part of the German state of
Saxony before World War II.
Bogatynia is one of the richest towns per capita in Poland, due to
its two principal enterprises: a brown coal mine (Kopalnia Węgla Brunatnego
Turów SA) and the associated thermal power station (Elektrownia
Turów).
Arms adopted on September 10, 1969
On September 13, 2007, The City Council choose the flag, presented here,
out of many proposals and ordered printing of paper miniatures for sale
to general public to get them acquainted with the new flag.
As it is here often, no report of what happened next is available.
In any case, the flag is not formally adopted yet.

The image at this
webpage leads to think that the flag is not B-W-B but B-Y-B tricolor
with coat of arms in the middle.

The photographic evidence you've found leaves no doubt your assumption
is right. It is, surely, the final version of the flag adopted after 2007
proposal.
The copy of the city's "statut"
available on BIP site is dated 2005 and doesn't mentions the flag at all,
although it provides the description and proof of the Arms. (zalacznik
Nr 3). The only other
website related to the flag is the one on the proposal mentioned
by me in the report which Jarig included on FOTW page. Unfortunately, there
is no follow up informing about the final version of adopted flag. There
is, however, the discussion
forum, where the answer of one of the respondents, suggests the yellow
color was under consideration.
IMVHO, your >gif< portrays the correct flag.
