Isn't this a BoA of the Moravian arms, whithout any defacement or difference? Is this acceptable or even legal?

No, it is not. It's a curious BoA of the Mirovice arms, see this webpage.
NB: the lion is uncrowned, and differs from Exner's image.
A lion is a lion is a lion, but not in Czechia!
